Mantano SAS (“Mantano”, “We”, “the Reseller”) provides users (“the User”, “the Customer”, “You”) of Mantano Store<\/a> (“The Site”) with a service (“Service”) for the sale of Assimil e-methods developed by Mantano in partnership with Assimil. By creating an account at Mantano Store or Assimil applications you agree to these Terms and Conditions.<\/p>\n

1.2. Scope of the General Terms and Conditions of Sale<\/h4>\n
The present general conditions of services relate to the sales of products and services from the Mantano Store<\/a> site, from the Assimil applications developed by the Mantano company, and from the “Stores” tab of the Bookari Reader applications. By subscribing, the User certifies that he\/she is fully capable of understanding, accepting, complying with and complying with the following terms, conditions, obligations, liabilities and warranties. The General Conditions of Sale are made available to users on the Site where they can be directly consulted.
\nThe General Conditions of Sale are opposable to the user who recognizes, by ticking a box provided for this purpose, to have had knowledge and to have accepted them before placing order as well as before downloading each application.<\/div>\n
The validation of the order by its confirmation is worth adhesion by the user to the General Conditions of Sale in force on the day of the order, whose conservation and reproduction are ensured by Mantano in accordance with the provisions of article 1369-4 of the Civil Code.<\/div>\n

1.4. Modification of the General Conditions of Sale<\/h4>\n
Mantano reserves the right to modify its General Conditions of Sale at any time.<\/div>\n
In case of modification of the General Conditions of Sale, the applicable General Conditions are those in force at the date of the order.<\/div>\n

2. Account creation<\/h2>\n
To use the Service, you need to create an account. When you create an account, we ask you to enter your registration information, such as your email address. This registration information is fully protected by our Privacy Policy<\/a><\/b>.<\/div>\n

2.1. Age of users<\/h4>\n
Our products and services are marketed and reserved for purchase by adults or with the consent of adults. Individuals under the age of 18 (“Minors”) are not permitted to use Mantano Store without the supervision of a parent or legal guardian. In addition, we do not knowingly collect or solicit personal information from children under the age of 13, nor do we knowingly authorize such persons to open an online account or post personal information on our Website. 3. Price<\/h2>\n
The prices of the products are displayed all taxes included. Under current European regulations, the applicable price of a digital product is that determined by the Publisher for the country of residence of the customer, and not for the country of the Reseller: indeed, the price of a digital product can vary according to the territory of sale. Therefore, depending on the country where you live (outside metropolitan France), it is possible that an update of the amount of your basket must be made when placing your order, once your country is detected, so that it is in conformity with the selling price(s) of the digital product(s) planned for this territory.<\/div>\n
Pursuant to Directive 2008\/8\/EC of 12 February 2008 on the common system of value added tax, the VAT applied when ordering digital product(s) from a member country of the European Union or a French overseas departments and territories is that of your country of residence.<\/div>\n
For all orders made outside the European Union and DOM-TOM, the price is automatically calculated excluding taxes on the invoice. Mantano reserves the right to modify its prices at any time in order to respect the price variations defined by the Editors, however the digital products are invoiced on the basis of the prices in force at the time of the validation of your order.<\/div>\n

The total amount of the price payable by the user is indicated on the order confirmation page.<\/div<\/p>\n

4. Offer<\/h2>\n
The online sales offers presented on the Site are valid, unless otherwise indicated, as far as possible and provided that the products appear in the electronic catalog published on the Site.<\/div>\n
Mantano reserves the right to make any modifications and improvements to the offer presented on its digital items download site that it deems necessary or useful and will not be liable for damages of any kind that may arise as a result.<\/div>\n
In addition, Mantano reserves the right, without notice or compensation, to definitively stop an offer it offers on the site downloading digital items and will not be liable for damages of any kind that may arise as a result.<\/div>\n

5. Order<\/h2>\n

5.1. How to access \u2013 Prior opening of an account on the Site<\/h4>\n
To place an order on the Site, all users must first create an account on the Site or, if they already have one on the Site, access their account, then confirm their acceptance of these Terms and Conditions.<\/div>\n
The account allows the user to access Mantano Store’s online sales services for digital products.<\/div>\n
All users guarantee the sincerity, veracity and accuracy of the information provided by them on the Site.<\/div>\n
The user undertakes to immediately inform Mantano of any loss or unauthorised use of his account. The identifiers are personal and the user expressly undertakes not to disclose them to any third party. As such, each user remains solely responsible for their use.<\/div>\n

5.2. Conclusion of the order<\/h4>\n
To place an order, the user fills his virtual basket indicating the selected products then clicks either on the “Buy now” button or on the “Confirm order” button and chooses the desired payment method.<\/div>\n
Before clicking on the button “Confirm order”, the user has the possibility to check the details of his order and its total price and to return to the previous pages to correct any errors or possibly modify his order.<\/div>\n
The confirmation of the order implies unreserved acceptance of these General Conditions of Sale by the user, it being specified that the order is validated by Mantano upon receipt of payment.<\/div>\n
An e-mail acknowledging receipt of the order and payment is sent by Mantano to the e-mail address associated with the user’s customer account as soon as possible following the conclusion of the order. This e-mail contains a link to a download page for the ordered digital files. The sending of this e-mail is an acknowledgement of receipt of the customer’s order. The access to the purchased files is only open to the customer personally and remains valid during a delay which depends on the type of file format of the ordered digital Items, as from the recording of the order.<\/div>\n
We recommend that you download the application as soon as you receive the order confirmation email. Indeed, access to purchased content may be limited to a certain period determined by the Publishers and Distributors. This delay being unknown to our services, it unfortunately cannot be announced on the Site.<\/div>\n
If the products or services you have purchased are not immediately available for download after payment, you will be entitled to a refund. The digital products that you have ordered on the Site generally remain available for re-downloading in the “My Downloads” section of your account. However, in certain circumstances, acquired digital products may no longer be available for re-downloading: for example, when a Publisher no longer has the digital distribution right to a work.<\/div>\n
Your order history can be consulted at any time on the site in the “My account” section and you can find and download all the digital products you have ordered in the “Downloads” section which are accessible in your personal account, if you have not done so directly via the confirmation page of your order on the Site.<\/div>\n

In case of difficulties, and in particular in case the customer would not receive this message on the e-mail address associated with his customer account, the customer can contact the Customer Support<\/a> indicated on the Site.<\/p>\n

6. Cancellation Policy<\/h2>\n
Unless otherwise provided in this Agreement, all sales are final.<\/div>\n
If you reside in a member country of the European Union, you have the right to terminate the agreement to purchase Digital Content on Mantano Store within 14 days from the day of purchase for a refund. Once the refund is made, you will no longer be entitled to access the digital content.<\/div>\n
Please note that once you download or access Digital Content that you have purchased, you no longer have the right to cancel the purchase of such Digital Content.<\/div>\n

7. Conditions of use<\/h2>\n
Digital products are, without exception, protected against copying by Technical Protection Measures.<\/div>\n
Digital products downloaded from Mantano Store are intended for personal and private use only. Any use contrary to the laws in force concerning intellectual property may be subject to prosecution. The digital products on Mantano Store are protected by the legislation in force in France concerning intellectual property and by equivalent foreign legislation. All reproductions, publications, modifications, adaptations, copies or other representations as well as the resale or rental of works are totally prohibited.
\nMantano draws the customer’s attention to the fact that protected digital products may not be freely transferred to external electronic devices outside the permitted limits (2 to 10 devices). These security features offer the customer maximum flexibility in the use of downloaded files and protect the rights of authors, performers and publishers of digital works.<\/div>\n

8. Contract<\/h2>\n

8.1. Conclusion<\/h4>\n

The sales contract is formed when the user sends confirmation of his order on the Site.<\/p>\n

8.2. Archiving and evidence<\/h4>\n
The archiving of communications, purchase orders and invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy, in accordance with the requirements of article 1348 of the Civil Code.
\nThese communications, order forms and invoices constitute proof of all transactions between a user of the Site and Mantano.<\/div>\n

9. Payment<\/h2>\n
Mantano provides the user with the following payment method: Payment by credit card, Paypal, Google Pay and electronic wallet. In all cases, the debit is made when the order is confirmed on the Site.<\/div>\n

10. Responsibility<\/h2>\n
Mantano shall not be held liable in the event of non-performance or improper performance of the contract due either to the fault of the user, or to the insurmountable and unforeseeable fault of a third party to the contract, or to force majeure.<\/div>\n

Similarly, Mantano cannot be held liable for non-compliance of the product with the legislation of the user’s country, which is responsible for verifying whether the product is not prohibited for sale in its country.<\/p>\n

For technical reasons, in particular maintenance or network failure, a temporary interruption of services is possible.<\/div>\n
The user acknowledges and accepts the constraints and limitations of the Internet network, in particular with regard to the transmission of information via the networks and data breach.<\/div>\n
The user is solely responsible for the use he makes of the services available on the Site, and can not hold Mantano responsible for any claim and\/or procedure made against him.<\/div>\n

11. Intellectual Property<\/h2>\n
All files, texts, comments, illustrations, works and images reproduced on the Site are strictly reserved under copyright and intellectual property by Mantano and its assigns worldwide. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use subject to different or more restrictive provisions of the Intellectual Property Code is authorized. Any total or partial reproduction or representation of the Site or of all or part of the elements found on the Site for purposes other than its use in accordance with its purpose as provided for by these General Conditions of Sale is strictly prohibited. Any resale, exchange, rental of files or transfer to a third party are strictly prohibited.<\/div>\n
Any use outside the scope of these General Conditions of Sale is strictly prohibited and any use for purposes other than private exposes the user to civil and\/or criminal legal proceedings.<\/div>\n
It is also recalled that the corporate names, trademarks and distinctive signs reproduced on the Site belong to Mantano and are protected under trademark law. The reproduction or representation of all or part of one of the above signs is strictly prohibited and must be subject to prior written authorization from Mantano.<\/div>\n

12. Personal Information<\/h2>\n
The information and data concerning the user are necessary for the management of his order and his commercial relations with Mantano. They can be transmitted to companies that contribute to these relationships such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations and to enable Mantano to improve and personalise the services offered to users and the information addressed to them.<\/div>\n
In accordance with the Data Protection Act of 6 January 1978, all users have the right to access, rectify and object to personal data concerning them. You can access your information, remove inaccuracies and correct them at any time by logging into your account and changing the relevant information. If you cancel your Mantano Store account, your identification, billing information and contact information may remain in our records for some time. We will respond to your request to access it within 30 days. We will retain your personal or contact information for as long as your account is active or as long as necessary to provide the services to you, unless you choose to withdraw that information. You can cancel your account via the web interface. 13. Dispute resolution<\/h2>\n

13.1. Claim<\/h4>\n
Any complaint must be sent by e-mail to the address support@mantano.com or by post to Mantano, Customer Service, 2, rue du Helder, 75009 Paris, France, indicating your name, first name, e-mail address and details of the order concerned.<\/div>\n

13.2. Mediation<\/h4>\n
In the event of failure of the request for complaint near the service consumers or in the absence of answer of this service within two months, the parts agree to resort to mediation to try to find an amicable solution to their dispute and to seize the justice only in the event of failure of the mediation.<\/div>\n

13.3. Territorial jurisdiction<\/h4>\n
For any dispute relating to the order form and these General Conditions of Sale, the competent court will be that of the place of residence of the defendant.<\/div>\n
